Terms

General Terms
1. All our offers are always non-binding.
2. Removing the signature from the products from SPIRIT LEATHER leads to extinguish of all warranty and indemnity claims. Pictures, drawings and models are copyrighted and remain our property. Who tries to clone SPIRIT LEATHER products, adulterate products into circulation, or market under a different name makes himself punishable.
3. Placed orders and bookings require confirmation of our effectiveness. A revocation of orders issued or orders upon receipt and confirmation with us is excluded or established a claim for damages amounting to 30% the agreed price.
4. Force majeure, strikes and natural disasters, equipment failure, material defects or deficiencies traffic release us from all obligations.
5. Changes of motor vehicles participating in the public roads must be registered in the registration papers. Failure to comply may void the approval. Any non-admission of the goods by the authorities does not entitle the purchaser to cancel and requires the seller to any compensation claims.
6. No liability for any ensuing damage.
The buyer takes the own risk, if he install incorrectly SPIRIT LEATHER products from us, misused or used without the consent of the vehicle manufacturer and it comes to damages of any kind to persons, environment or product.
7. Pads or seats with suction cups are not in the field of public traffic allowed.
8. Any damages caused by improper installation of the SPIRIT LEATHER products on the vehicle can’t be claimed. Brackets or screws must be taped if necessary. Dents or scratches by rest of the seat can’t be rejected.
9. Custom manufacturing as well as custom work depends on the completion and delivery time which can take up to a month. It should be noted that tolerances in the mm range are possible, because this is real craftsmanship.
Terms of delivery

Sale, delivery and payment of these terms and conditions apply to all sales and deliveries, so for all orders and shipment of goods by purchasers in order by telephone, fax, email or by letter. Verbal agreements and differences are only valid with written confirmation. At the latest upon acceptance of delivery or commencement of performance conditions are deemed accepted.

The delivery to the costumer is that we ourselves are supplied on time and correctly. Damages are excluded. We are entitled to partial deliveries and collection of several orders at the same address
Delivery, shipping costs, risk of transfer

Delivery will be made to each individual case reported shipping costs. All risks and dangers of the shipment shall pass to the customer once the goods have been handed over by us on the logistics contractor and the customer is an entrepreneur.
Warranty and Liability

SPIRIT LEATHER guarantees that the goods at the time of handing over any agreed quality or is free from defects.

The customer must inspect the goods of defects and damages immediately after receipt of the delivery is complete and reports them within two weeks upon receipt by us. If not, the product shall be deemed as approved.

The colors are only approximate. Slight variations of the color through various tanning processes of the leather skins are possible and can not be objected to. Reorders from certain types can provide differences of the color and has to be known. Exotic leathers like ostrich, stingray, snake and suede, etc., are not weatherproof without any aftercare. Scarring and skin creases on the leather skin are completely natural and testify to its authenticity, so it can’t be objected to.
The warranty period is 2 years for new goods, 1 year for used goods. The warranty commences with the receipt of the goods.
In the case of a defect, you have the choice of the legal rights for a rectification, and if the statutory requirements further claims for a reduction, cancellation, damages or compensation.
The remedy may be refused if it is only possible with disproportionate costs. A resignation is excluded if the defect is minor and insignificant.
Condition for the warranty claims of customers, is that the defect is not caused by misuse or overuse, or the goods have not been used and maintained in accordance with our recommendations and the defect is caused.
If a defect is older than 6 months after the goods have been received, then the customer has the burden of proof that the item was defective at the transport.

Right of withdrawal for consumers
SPIRIT LEATHER grants the law right of withdrawal for consumers, natural persons who concludes a legal transaction for a purpose that is neither commercial nor its independent vocational activity may be attributed. Excluded are work orders, single productions or special orders. Please note that a right of withdrawal in accordance with law provisions (e.g. under §312 d paragraph 4 BGB), among other things does not exist for distance contracts for the supply of goods that are produced according to customer specifications or clearly tailored to personal needs.
Withdrawl

You may withdraw your contractual statement within two weeks without giving any reasons by writing form (e.g. letter, fax, e-mail) or by returning the product. The period begins at the reception of the products and detailed cancellation policy in writing. The revocation period is sufficient to send the revocation or the product. Consequences of a withdrawal

In the case of an effective withdrawal, the mutually received benefits and any benefits derived (e.g. interest) has to be surrendered. If you can return us the received benefits not completely or a part of it or only in a deteriorated condition, you have to pay a compensation for the value. This does not apply if the deterioration is exclusively due to their inspection – as it would be possible in a store – is due. In addition, you can avoid paying compensation by not using the goods like an owner and omitting everything, which impairs their value. Returned goods are accepted only when they are released and the return of the product is agreed with us. We set in bill to you the remanufacturing costs, at least 15% of product value. For returned goods, a credit is issued, which has up to 12 months validity. For redemption of an ordered product which caused not from our store, or a missing of the necessary papers to complete the work, we will charge a processing fee of 10% of the purchase value. You have to bear the costs of a return if the delivered product matches with the ordered one and if the price of the item which has to be returned does not exceed € 40.00, or if you not provided yet a compensation or the agreed partial payment at the time of the withdrawal. Otherwise is the return of the product free of charge for you. Obligations to reimburse payments must be made within 30 days. The period begins with the declaration of revocation or the return of the product and for us with their reception.
Prices

Our offers are given free and are non-binding. The prices includes VAT plus shipping costs and possible surname confirmation fee. In the package area accrues € 3,- for packaging costs. Larger pieces on request.

Payment and default of acceptance
Our bills are payable in advance or on delivery with surname confirmation. If the product will be not accepted by surname confirmation we will calculate this separately and will sent a new bill. May the bill be not compensated within 10 days, will the buyer may be in default without the need of a remind. We are entitled to calculate remind costs and default-interests (3% above the respective discount rate of the Bundesbank) from the 11th day. Once the bill is paid, the product will be shipped.
Performance and Jurisdiction

Jurisdiction and also performance for all disputes between the parties from the contractual dispute, as far as the buyer is a merchant, legal person under public law or public law special fund, is the headquarters of the seller.

Retention of Title
All products of SPIRIT LEATHER remain our property until full payment of the purchase price.

The customer confirms with his signature, through the online confirmation and by issuing an order, the acceptance of our Terms & Conditions and declares that he has read and understood them.
